Disposition of Last Remains – this is a document where you can state your wishes regarding end of life ceremonies and disposition such as burial or cremation. It is important for you to put these wishes in writing so that your loved ones know they are carrying out your wishes.

 

Pre-Marital and Marital Agreements – In Colorado, a surviving spouse can reject the Will of his or her deceased spouse and make certain elections against the deceased spouse’s estate. If you would like to protect against this, you can execute a marital agreement where both spouses agree not to assert their rights against the other spouse’s estate. This is usually more important in second marriages where one or both spouses have children from a previous marriage. Marital agreements can cover several other issues as well and can be incorporated into your estate plan.

 

Instructions and Location of Information – It is a good idea for everyone to make a list of assets and directions for loved ones to use in case of death or incapacity. This list should include copies or location of documents such as wills, trusts, statements from bank accounts, investments, insurance policies, deeds, title to vehicles, and location of safe deposit box. It is helpful to up-date this information on a yearly basis.
