Theft, Robbery and Burglary related charges
Often people are confused about the difference between theft, robbery, and burglary. Each one of these has a different legal meaning.
Theft occurs when a person knowingly takes property of value from another without authorization or by threat or deception. The penalties of theft can vary from a misdemeanor to a felony depending of the value of the property stolen. Theft can also occur in a series. For example, a person can be charged with theft series by stealing from a convenience store multiple times in a six month time period with the value exceeding $1,000.
Theft can include motor vehicle theft as well. There are many types of motor vehicle theft. An example of aggravated motor vehicle theft occurs when someone knowingly exercises control of a vehicle without permission and has possession of the vehicle for more than twenty-four hours.
Burglary is where someone breaks and enters into a building with the intent to commit a crime. Burglary is a felony charge.
Robbery is different from burglary and theft in that the threat or actual use of force is used to take property. If a weapon is involved or someone is injured, punishment is usually increased. Robbery is a felony charge.
In all of these property crimes, police may intimidate you by overcharging the crime. The police and prosecutors may do this to see if they can get a plea bargain on your case. It is important to investigate your case early to determine whether the police did an accurate investigation. Often police miss valuable information that can potentially help you in your defense.
